Terms and Conditions

These terms govern your use of the Deal Shop Market website and the agreement between you and the Company. Please read them carefully before using the Service.

Acknowledgment

By accessing or using the Service you agree to be bound by these terms. If you do not agree with any part of them, you should not use the Service. You represent that you are at least 18 years old; the Company does not permit anyone under 18 to use the Service.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use and disclose personal information, and to our Returns and Refund Policy, which forms part of these terms.

Definitions

  • Company means Deal Shop Market.
  • Goods means the products offered for sale through the Service.
  • Order means a request by you to purchase Goods from us.
  • Service means the website operated by the Company.
  • Third-Party Service means any content, product or service provided by a party other than the Company that is displayed, made available or linked through the Service.
  • Website means Deal Shop Market, available at dealshopmarket.com.
  • You means the individual accessing the Service, or the entity on whose behalf that individual acts.

Orders, Pricing and Availability

Listings on the Service are an invitation to buy, not a binding offer. An order is accepted when we confirm it and, for physical Goods, when the item is dispatched. Prices are shown in the currency stated on the listing and include applicable taxes; nothing further is added at checkout.

We may correct pricing or descriptive errors, limit quantities, and decline or cancel an order where stock is unavailable, where a listing was materially mispriced, or where we suspect fraud. If an order is cancelled after payment we refund it in full by the original payment method.

Payment

Payment is taken by our payment providers, who process card details on their own secure systems. By submitting an order you confirm that you are authorised to use the payment method provided and that the billing information you give is accurate. Where a subscription or membership renews automatically, the renewal terms are shown at purchase and can be cancelled as described there.

Delivery and Digital Goods

Physical Goods are delivered to the address you supply, and delivery estimates are estimates rather than guarantees. Risk passes to you on delivery. Digital Goods, including eGift cards and software licences, are delivered electronically, usually within minutes, and may carry region restrictions, activation deadlines or account conditions that are described on the listing. Please redeem digital codes promptly so that any problem can be resolved while it is still fixable.

Returns and Refunds

Returns, cancellations and refunds are governed by our Returns and Refund Policy, which sets out the fourteen-day cancellation window, the condition Goods must be in, the categories that cannot be returned for hygiene or licensing reasons, and how refunds are paid.

Intellectual Property

The Service, including its design, text, graphics, logos and code, is owned by or licensed to the Company and is protected by intellectual property laws. You may use the Service for personal, non-commercial purposes. You may not copy, reproduce, republish, sell or exploit any part of it without our prior written permission, and you may not use our name, marks or imagery in a way that suggests endorsement or affiliation without consent.

Prohibited Uses

You agree not to use the Service to break any law, to infringe the rights of others, to transmit malware or harmful code, to attempt to gain unauthorised access to any part of the Service or its infrastructure, to scrape or harvest data by automated means, to interfere with the normal operation of the site, or to submit false, misleading or fraudulent information.

Third-Party Services and Links

The Service may include links to, or content from, third parties we do not own or control. We do not endorse and are not responsible for those services, and we are not liable for any loss arising from your use of them. Please review their terms and privacy policies before relying on them.

Disclaimer and Limitation of Liability

The Service and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid for the Goods concerned. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Product images are illustrative. We describe Goods as accurately as we can, and we ask that you read the specification and the safety information supplied with any product before use.

Indemnification

You agree to indemnify and hold harmless the Company, its officers, employees and agents against claims, liabilities, damages and reasonable costs arising from your breach of these terms or your misuse of the Service.

Governing Law and Disputes

These terms are governed by the laws of Minnesota, United States, without regard to conflict-of-law rules. If a dispute arises, we ask that you contact us first at [email protected] so we can try to resolve it informally. Where a dispute cannot be settled informally, it will be subject to the exclusive jurisdiction of the courts of Minnesota, United States.

Severability and Waiver

If any provision of these terms is held to be unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will continue in full force. Our failure to enforce a right or provision is not a waiver of it.

Changes to These Terms

We may revise these terms at any time. Where a change is material we will give reasonable notice by email or with a notice on the Service. Continuing to use the Service after a change takes effect means you accept the revised terms.
